The Assam Cabinet on September 19, 2025, approved a Standard Operating Procedure (SOP) under the Immigrants (Expulsion from Assam) Act, 1950, to streamline the process of identifying and expelling illegal immigrants from the state.
According to the decision, District Commissioners (DCs) and Senior Superintendents of Police (SSPs) will be guided by the SOP in handling such cases. Once a person is identified as an illegal immigrant, the DC will issue a notice requiring the individual to produce evidence of Indian citizenship within 10 days.

If the evidence is deemed insufficient, the DC will record the finding in writing and pass an expulsion order under Section 2(a) of the Act, giving the person 24 hours to leave the state. For Doubtful Foreign Nationals (DFNs) identified by Foreigners’ Tribunals, expulsion orders will be issued without further verification, as such cases have typically exhausted legal remedies up to the High Court and Supreme Court.
The SOP further empowers authorities to ensure immediate push-back of illegal immigrants detected near the zero line or within 12 hours of entering Assam. Those failing to comply with expulsion orders may be detained in holding centres or handed over to the Border Guarding Force.
As part of the process, biometric and demographic details of each individual identified as an illegal migrant will be recorded on the Foreigners Identification Portal. Officials said this step is critical for maintaining proper documentation and preventing re-entry.
The Cabinet termed the SOP a “milestone in the war against illegal infiltration,” underlining the state government’s commitment to tighten enforcement against unlawful migration.
